Judgment
Vivek Bharti Sharma, J
Applicant Deepak Kumar, who is in judicial custody in Case Crime No.0004 of 2024 under Section 67A of IT Act, under Sections 504 & 506 of IPC and under Section 11/12 of POCSO, Thana Askote, District Pithoragarh, has sought his release on bail.
Learned counsel for the applicant/accused would submit that the applicant/accused is innocent and has been falsely implicated in the instant crime; that, the applicant/accused is not named in the FIR; that, the charge sheet has been filed; that, the applicant/accused is languishing in jail since April 2024 and the applicant/accused is entitled to be released on bail.
Learned counsel appearing for the State would fairly admit that the present applicant/accused is not named in the FIR.
In view of the above, but, without expressing any opinion about merits of the case before the Trial Court, this Court is of the view that this is a fit case for bail.
The bail application is, accordingly, allowed. Let the applicant be released on furnishing bail bond with two sureties in the amount of ₹40,000/- and personal bond of the like amount to the satisfaction of the learned Trial Court.
