This Criminal Misc. Bail Applications have been brought under Section 439 of Cr.P.C., seeking regular bail in connection with F.I.R. No. 140/2020

registered at Police Station Ramganj Mandi, Kota (Rural) for offence under Sections 143, 323, 341 and 456 (Section 384 IPC added lateron).

It has been argued on behalf of the petitioners that their name does not appear in the FIR. Co-accused Prabhakar whose name has been appearing

in the FIR has been released on bail by the Co-ordinate Bench of this Court. FIR has been registered under Sections 143, 323, 341 and 456 and

Section 384 IPC added lateron. Case is triable by Magistrate Court.

Heard and perused the material available on record.

Learned Public Prosecutor has opposed the bail application.

I have considered the contentions.

On consideration of arguments/submissions of both the parties, perusal of material on record and looking to the facts and circumstances of the case,

particularly to the fact that Co-accused Prabhakar S/o Jeetu @ Jitendra has been released on bail by the Co-ordinate Bench of this Court on

04.06.2020 but without commenting upon detailed merits of the case, this court deems it fit to enlarge the accused on bail.

Therefore, the bail applications are allowed. Accused-petitioners (1) Deepak Baddu S/o Jugal Kishore and (2) Hitesh Khatri S/o Manoj Khatri shall

be released on bail in FIR No. 140/2020 registered at Police Station Ramganj Mandi, Kota (Rural), if they are not wanted in any other case, provided

each of them furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) together with two sureties in the sum of Rs.25,000/-

(Rupees Twenty Five Thousand only) each to the satisfaction of the learned trial court with the stipulation that they shall appear before that Court and

any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
