Judgment

Mr. Nand Lal Thakur, learned Additional Advocate General, has filed status report through e-mail and copy of the same has been taken on record. Mr. Manoj Pathak, learned counsel for the petitioner has also received copy of the status report.
As per the contents of the status report, the Police received a secret information about sowing of opium. After that, the Police complied with the provisions of Section 42 (2) of the Narcotic Drugs and Psychotropic Substances Act, 1985 ( after now called as " NDPS Act") and proceeded towards the spot.
The Investigating Officer associated independent witnesses and reached the fields of the present bail petitioner, Deep Ram, where they noticed that he had planted cauliflowers in two fields and opium in one field. The Police stated that the bail petitioner had plucked the opium plants and thrown below the field and from appearance the opium plants were fresh. After that, the Police counted the plants and found them to be 450 in number. The Police took 10 plants for chemical testing and sealed the same. After conducting the remaining procedural requirements under NDPS Act and Cr.PC, the present FIR was registered.
It is stated by learned Additional Advocate General that the petitioner had joined investigation.
Given the fact that the recovery has already taken place, interim order dated 10.6.2020, is made absolute, on the same terms and conditions.
Accordingly, the present petition stands disposed of.
