Judgment
By filing this petition under Section 439 of the CrPC, the petitioner, namely- Sri Deep Jyoti Boro, who is in custody since 14.02.2022, has prayed for releasing him on regular bail in connection with Bokajan P.S. Case No.11/2022, registered under Section 380 of the IPC.
Heard the learned counsel for both sides. Also perused the documents annexed.
Informant alleged that some miscreants stolen away certain articles from his Hardware Shop, like- one desktop, cash money Rs.20,000/-, water pumps, Paints etc. From the Forwarding Report of the accused persons and the seizure list, it reveal that only 5 litres of paint was recovered from the possession of the present accused petitioner. The Forwarding Report also reveals that the petitioner is a receiver of those stolen articles.
Considering all entirety of the matter and also the value of stolen articles, that have already been seized, this Court is of the opinion that further custodial detention of the accused petitioner is not warranted.
Accordingly, the accused petitioner is hereby by allowed to go on regular bail on furnishing bail bond of Rs.20,000/- with surety of like amount before the learned SDJM (M) Bokajan, Karbi Anglong.
The bail application stands disposed of.
