The present Writ Petition has been filed under Article 226 of the Constitution of India with the following prayers:-

“(i) Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to immediately permit the petitioner to commence her internship as per applicable rules and guidelines.

(ii) Direct the respondent no.2 to accept the undertaking of the petitioner/family to deposit the outstanding fees in reasonable installments or after internship.

(iii) Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to decide the representation of the petitioner.

(iv) Issue any other writ, order or direction which this Hon’ble Court deems fit and proper and award cost of the petition.”

The case of the petitioner Miss Deeksha is that she has completed her MBBS course from the respondent no.2 in the year, 2025. She deposited her tuition fee/ academic fee of Rs.5,78,000/- for her final year on 14.02.2025. Her mother had suffered from cancer and underwent prolonged treatment, due to which her family had to bear heavy medical expenses. Therefore, she could not deposit Rs.3,00,080/- for her internship. The respondent no.2 is not willing to permit her to commence her medical internship on the ground of non clearance of dues amounting to Rs.3,00,080/-.

Heard Mr. Deep Chandra Joshi, learned counsel for the petitioner, Mr. K.S. Mehta, learned Additional C.S.C. for the respondent no.1 and Mr. Shubhang Dobhal, learned counsel for the respondent no.2.

Mr. Deep Chandra Joshi, Advocate, for the petitioner submitted that Rs.3,00,000/- is already deposited as security money and the petitioner undertakes to deposit the said amount i.e. Rs.3,00,080/- in six installments in six months from today.

Having considered the facts and circumstances of this case, the respondent no.2 is directed to permit the petitioner to commence her internship subject to deposit of Rs.3,00,080/- by her in six installments in six months, as prayed by her. The first installment shall be submitted along with a certified copy of this order.

The Writ Petition (WPMS No.1767 of 2025) stands disposed of accordingly.
