Judgment
Vipin Sanghi, CJ
1) The present special appeal is directed against the judgment dated 22.06.2023, passed by the learned Single Judge, in Writ Petition (S/S) No. 896 of 2023. The learned Single Judge has dismissed the writ petition preferred by the appellants.
2) The appellants have been serving as guest teachers in the schools where they were appointed in that capacity. The respondents have undertaken the process of direct recruitment of teachers to fill up the vacant posts of Assistant Teachers (L.T.) and Lecturers, and has also undertaken the process of regular promotion.
3) The petitioners approached the Court with a plea, that they should not be displaced from the schools where they were serving as guest teachers, and the directly recruited Assistant Teachers (L.T.) and Lecturers, who have been regularly promoted, should be posted in other schools, wherever vacancies occur.
4) The appellants have absolutely no vested or legal right to make any such prayer to the Court. It is for the respondents to post the directly recruited Assistant Teachers (L.T.) and Lecturers upon their selection / promotion. If the submission of the appellants were to be accepted, it would mean that they have even higher right then a regularly appointed Assistant Teacher (L.T.) and Lecturer, who can be subjected to transfer from one school to another.
5) We see no reason to interfere with the impugned judgment. The appeal is, accordingly, dismissed.
6) Interim Relief Application (IA No. 01 of 2023) also stands disposed of.
