The petitioner through instant petition under Article 226 of the Constitution of India is seeking direction to respondent No.2 to forthwith accept, process and register the conveyance deeds of its members.
Learned Senior counsel for the petitioner submits that petitioner-association comprises 111 members and they have individually applied for registration of the conveyance deed in respect of units in Capital Gateway, Sector 111, Gurugram. The applications have to be processed as per the procedure prescribed under the Registration Act, 1908, but Registering Authority is not entertaining the applications.
Learned State counsel, on instructions from Mr. Jagdish Chand, Tehsildar-cum-Joint Sub-Registrar, Gurugram, submits that jurisdictional Tehsildar would register conveyance deeds of members of petitioner- association, if they approach as per prescribed procedure.
Faced with this, learned Senior counsel for the petitioner submits that members of petitioner-association have already filed online applications. If any member has not filed the application, it would be filed.
The petitioner is seeking registration of conveyance deed of its members and respondent is not denying its registration, thus, virtually there is no dispute. There seems some procedural or technical issue.
In the backdrop, respondent No.2 is hereby directed to process application of members of petitioner-association and do the needful within two months from today subject to compliance of any legal objection raised by Registering Authority.
The petition stands disposed of in above terms.
