The Petitioner was allotted admission to an engineering course in National Institute of Technology, Rourkela under All India Quota seats pursuant to the Entrance Test conducted by Opposite Party No. 2 under the reserved category for physically handicapped The National Institute of Technology, Rourkela/Opposite Party No. 3-4, at the time of admission, verified the assigned Locomotor Physical Disability to the extent of 50%, and upon evaluation by a Medical Board, found that the stated disability to be upto 40% and therefore held the Petitioner ineligible in the physically handicapped category. Hence, this Petition.
At the time of hearing, in view of fresh evaluation of disability of the Petitioner by SCB Medical College & Hospital, Cuttack notifying the disability to be less than 50%, learned counsel for the Petitioner prays for permission to withdraw the writ petition.
Accordingly, the writ petition is disposed of as withdrawn.
