THIS is a dispute arising out of non-provision of return facilities by a Romanian Air transport from London even though the tickets were purchased in advance for the return trip.

COMPLAINANT purchased two Air tickets from the Opposite Party No. 2 at Bhubaneswar bearing Nos. 2814290434780 and 2814290434781 at a cost of Rs. 11,749/- each. The tickets were confirmed for onward journey on 22nd July and returned on 9th August. While at London, complainant wanted to confirm the return tickets as required and tried to contact TAROM''s Office at London over telephone and there was no reply, he went to that place, found the office closed and he was informed by some other travel agencies that the TAROM''s Office has been closed and was also informed that the complainant should contact the British Airways on the TAROM''s Office based at London is under liquidation. Accordingly, the complainant contacted the British Airways who told him that there was no certainty of the TAROM''s flight from London and that they cannot obliged him to travel on TAROM''s ticket. Finding no other alternative, complainant had to return in British Airways flight borrowing some money from a friend at London and paying 620/- towards fare. Opposite Party No. 1 denies to have sold the ticket to the complainant and states that the tickets were sold to Central Points Travels & Tours on 18-7-1991 on part payment but we are not concerned to whom they have sold. Complainant, however, has produced the tickets that have been purchased from Jet Tours and the tickets have been issued by TAROM and we are inclined to hold the opposite party Jet Tours represented by Mr. Yosobant Patnaik and the Sales Manager who has sold these two particular tickets to Central Point mentioning the name of Khadanga/DMR.

As there was no direct transactions with the opposite party No. 1 by the complainant and as the complainant has purchased the tickets from the Jet Tours at the Bhubaneswar, we are inclined to place the responsibilities of compensating the complainant with the proprietor of Jet Tour.

THEREFORE, we direct that Yosobanta Pattnaik Proprietor Jet Tours shall return the cost of the unused return ticket of TAROM amounting to Rs. 11,749/-. Reimburse the amount of the cost of return ticket of Rs. 1000/- purchased from British Airways along with interest amounting to Rs. 27,280/-. Further he shall pay an amount of Rs. 5000/- as cost. With the above directions, we dispose of the dispute. Complaint allowed with costs.
