Judgment
Arindam Lodh, J
Heard Mr. S. Lodh, learned counsel appearing for the accused-applicant. Also heard Mr. Raju Datta, learned PP appearing for the State-respondent.
When the matter has come up today, Mr. Lodh, learned counsel for the applicant has submitted that due to compelling circumstances, the accused-applicant and his father could not pay the amount as they had given undertaking previously before this Court. However, both the accused-applicant and his father have prayed for modification of the orders dated 28.03.2024 and 08.04.2024 to the extent that the Court may grant 2(two) months further time to pay balance amount of Rs.13,00,000/-(Rupees Thirteen Lakh) in two installments.
Mr. Datta, learned PP has submitted that considering the main object to refund the balance amount of Rs.13,00,000/-(Rupees Thirteen Lakh) to the complainant another 2(two) months’ time may be granted.
Accordingly, I direct the accused-applicant as well as his father to pay the entire amount to the complainant within a period of 2(two) months in two installments.
List the matter on 27.05.2024. It is made clear that no further adjournments would be allowed.
