Judgment
This Application I.A. No. 849 of 2022 has been filed by the Applicant praying for following reliefs:-
“a) Restrain the Respondent No.3 & Respondent No.4 from carrying out any demolition activities as well as illegal felling of trees at the sole asset of the Corporate Debtor.
b) Restrain Respondent No.1 to hold stakeholders meeting on 28.03.2022 for finalization of balance sheets.
c) Direct the Respondents 1, 3 & 4 to maintain status quo as regards the sole asset of the Corporate Debtor.
d) Pass any such directions/orders as this Hon’ble Tribunal may deem fit.”
In the Company Appeal (AT) (Ins.) No. 600 of 2021 which was entertained by this Appellate Tribunal on 16.08.2021, no Interim Orders were passed for more than six months. The Liquidator is proceeding in pursuance of the orders passed by the Adjudicating Authority with the liquidation proceedings.
At this juncture, the proceedings are already underway by the Liquidator. We see no reason to grant any interim relief in this Application. I.A. No. 849 of 2022 is misconceived. It is rejected.
