Judgment
Sudhanshu Dhulia, J
This writ petition was dismissed for non-prosecution on 09.05.2019. Now a restoration application (MCC No.461 of 2019) has been filed by the petitioner for recalling the order dated 09.05.2019.
On the grounds urged and in the interest of justice, the restoration application is allowed. The order dated 9.05.2019 is hereby recalled. The writ petition is restored to its original number.
The petitioners before this Court are committees of management of three different degree colleges who simply seek implementation of the Government Order dated 23.06.2010.
The order dated 23.06.2010 merely states as to how disposed of the complaints against Class - A, B, C and D employees of the State Government has to be dealt with. Primarily it stresses upon the fact that the Government has been receiving anonymous and fake complaints against the government officials and in order to ensure the genuineness of these complaints, the authenticity and the identity of the complainant must firstly be established and only if prima facie case is found, then further action be taken.
However, learned counsel for the respondent no.3, would contend that this Government Order is only for the State Government employees and not for the employees of the petitioners' degree colleges.
Technically speaking what has been stated by the learned counsel for the respondent no.3 appears to be correct, but on the other hand, the Court cannot loose sight of the fact that what the petitioners are seeking is the implementation of a very fair procedure contained in the above Government Order.
This Court has also been informed that similar guidelines have also been issued by the Central Vigilance Commission in order to check fake complaints against the officers.
In view thereof, the petitioners would be at liberty to make a representation before the Chief Secretary, Department of Personnel, Government of Uttarakhand as well as to the concerned University or the authority for implementation of the Government Order dated 23.06.2010, which shall be considered in its true spirit as expeditiously as possible but definitely within a period of twelve weeks from the date of production of a certified copy of this order.
The writ petition stands disposed.
