David Kumar Bhuarya vs State Of Chhattisgarh

Learned counsel for the petitioner submits that by impugned order dated 23.12.2021 petitioner has been suspended and that order has been passed

pursuant to the order of Collector dated 30.12.2019.

Learned State counsel submits that the aforesaid order is appealable.

Mr. B.D. Guru, learned counsel for the petitioner, submits that change of headquarter is impermissible in law in view of the decision rendered by

this Court in WPS No.2062/2016 (Panchu Ram Thakur vs. State of Chhattisgarh & Ors.) decided on 21.06.2021.

Be that as it may, petitioner is at liberty to file appeal before the Appellate Authority (other than Collector) in view of the order dated 30.12.2019,

which will be considered and decided by the Appellate Authority within 45 days from the date of filing of the appeal. Meanwhile, order directing

change of headquarter from Village Umarwahi, Tahsil Chhuriya, to Khujji circle Chhuriya shall remain stayed till appeal is decided. However, this

Court has not precluded the Appellate Authority to consider the application for grant of stay, if any, filed by the petitioner.

With the aforesaid direction the instant writ petition stands finally disposed off. No order as to cost(s).
