Judgment
The petitioner is aggrieved against citation notice contained in annexure2 dated 5.2.87 whereby the petitioner is required to deposit C.P. tax within seven days failing which same will be recovered as arrears of land revenue. The grievance is that no notice has been given nor any opportunity to explain his case has been given to the petitioner. The petitioner submitted a representation against citation notice on 25.4.87 which was not disposed of by the authority concerned and a citation for recovery of amount as arrears of land revenue has been issued. As a short question is involved, we propose to decide the writ petition finally. The citation ought to have been issued after disposal of the representation.
Accordingly, the writ petition is allowed with the direction that the Executive Officer, Nagar Palika, Rudauli shall dispose of the representation of the petitioner contained in annexure3 to the writ petition within a period of three weeks from the date of presentation of this order.
Copy of this order will be issued to the learned counsel within one week on payment of usual charges.
