Judgment

This application under Section 482 of Cr.P.C. has been filed seeking modificiton of order dated 08.09.2021 passed in M.Cr.C. No. 42975/2021 by which the applicant has been granted bail on furnishing cash surety of Rs. 1,00,000/-.
It is submitted that the Hon'ble Supreme Court in the case of Sharo@Shahrukh v. The State of M.P. by order dated 06.09.2021 passed in SLP (Cri.) No. 6321/2021 had also permitted the accused to deposit original title-deed(s) of immovable property worth of more than the said amount, therefore, the applicant may also be granted the said liberty. It is further submitted that the judgment passed in the case of Sharo alias Shahrukh (supra) was also followed by this Court while deciding the bail application of the co-accused Lokendra on 01.10.2021 passed in M.Cr.C. No. 46502/2021.
Per contra, the application is opposed by the Counsel for the State.
The Hon'ble Supreme Court in the case of Sharo alias Shahrukh (supra) had given liberty to the accused to deposit original sale deeds of immovable property worth of more than the cash surety. Accordingly, the order dated 08.09.2021 passed in M.Cr.C. No. 42975/2021 is modified. It is directed that the applicant be released on bail either on furnishing cash surety or Rs. 1,00,000/- ( Rupees One Lac Only) or in the alternative by deposing his original title-deed(s) [not Rin Pustika] of the immovable property worth of more than the said amount.
with aforesaid observations, this application is finally disposed of.
The order passed today shall be treated as part of order dated 08.09.2021 passed in M.Cr.C. No. 42975/2021.
