Judgment

By the order dated 20.10.2021, the learned counsel for the applicant/petitioner was allowed 3(three) weeks' time to produce the death certificate of the petitioner No. 3 who was sought to be substituted.
Today, Mr. H. Nongkhlaw, learned counsel for the applicant/petitioner has produced the death certificate of Shri Osteroy Jyrwa, who expired on 12.06.2021 and the same is accepted and made part of the record. Also seen the resolution whereby the applicant has been appointed by the clan in place of the deceased petitioner No. 3.
Though, the applicant is stated to be the member of the clan of the deceased petitioner No. 3, and therefore will have the vested right to be substituted in his place, however, to avoid certain questions as to whether his rights to sue survives, the applicant being a necessary party as he is now representing the clan is accordingly impleaded as petitioner No. 3. Registry to make necessary corrections in the Cause Title.
The instant Misc. Case stands disposed of.
