Judgment
The prayers in this Original Petition (Civil) filed under the enabling provisions of Article 227 of the Constitution of India are as follows :
"i. To issue appropriate order setting aside Ext.P9 order in I.A. No.552/2017 in AS No.123/2016 of Sub Court, Punalur;
ii. To issue appropriate order allowing the I.A. No.552/2017 in AS No.123/2016 of Sub Court, Punalur;
iii. To issue appropriate order directing the Sub Court, Punalur to consider and pass orders afresh on Ext.P7 I.A. No.552/2017 in AS No.123/2016;
iv. Issue an appropriate order staying all further proceedings in AS No.123/2016 of Sub Court, Punalur;
v. to issue such other appropriate order or directions as this Hon'ble Court may deem just and proper to issue in the circumstances of the case. "
Heard Sri.S. Santhosh Kumar, learned counsel appearing for the petitioner and Sri.J. Harikumar, learned counsel appearing for respondent Nos.1 and 2. Though notice has been duly served on the 3rd respondent, there is no appearance for that party.
Sri.S. Santhosh Kumar, learned counsel for the petitioner submits on the basis of the instructions from his party that the above O.P.(C) may be closed as the reliefs sought for have practically been secured in view of the subsequent development in the matter.
In the light of the submission made on behalf of the petitioner, it is ordered that the above O.P.(C) will stand dismissed as not pressed.
