The case is listed today for compliance of the order dated 29.01.2016.

Counsel of the respondents no. 2 and 4 submits that in compliance of the direction of this Court, the examination form along with the fees deposited by the petitioners have been forwarded to the respondent no.1 and the copy of sending the examination form to the respondent no.1 along with the index is placed on the record today. The same is taken on record. On such paper it appears that examination forms have been sent to the respondent No.1.

Apart the aforesaid on behalf of the respondent No.3, the return/response has also been filed. The same is placed before us. The same is taken on record. According to such response and its annexed papers, against some of the petitioners herein some fees of the institution of the respondent No.3 either tuition fees or other fees till the extent of Rs.1,000/- to Rs.5,000/- are outstanding and its synopsis is annexed with the reply as Annexure R/3-1 and Annexure R/3-2. Counsel of the respondent No.3 submits that if the petitioners are ready to deposit the sum then his institution is ready and willing to regularise all necessary formalities of their admission in the institution. On the other hand petitioners'' counsel submits that he did not have any objection if this petition is disposed of with a direction to the petitioners to deposit the remaining outstanding sum of the tuition fees and other fees of the respondent no.3 with a direction to such institution subject to deposit of such sum within seven days such institution will regularise the admission of all the concerning petitioners so that they may appear in the examination as students of the respondent No.3.

Having perused the petition and the response and their annexed papers also keeping in view the aforesaid submissions of the counsel, this petition is disposed of with a direction to the petitioners to deposit the remaining outstanding tuition fees and other fees as stated in Annexure R/3-1 and Annexure R/3-2 within seven days from today and pursuant to it the authorities of the respondent no.3 is directed that subject to depositing the aforesaid remaining sum of the fees of the concerning students their admission be continued and regularised and they be permitted to appear in the alleged examination through such institution. In such background, the respondent No.1 is also directed that on the basis of the examination forms send by the respondent No.2 and 4 to the respondent No.1 along with the examination fees in compliance of the interim order of this Court dated 29.01.2016 by accepting the same permit the concerning petitioners to appear in the alleged examination in accordance with the procedure prescribed. Till this extent the order Annexure P/1 annexed with the petition is modified.

The petition is disposed of as indicated above. There shall be no order as to costs.
