Judgment
Surjit Singh, J.—Heard and gone through the record.
Petitioner has been arrested in a case, u/s 20 of the Narcotic Drugs and Psychotropic Substances Act, for possessing Charas, weighing 400 grams. Though the quantity is less than commercial, his bail plea has been rejected by the trial Court, on the ground that he is Nepali National and it is quite likely that he may, like other Nepalis involved in criminal activities, escape to Nepal, after release on bail.
Learned Counsel for the Petitioner submits that the Petitioner belongs to Uttrakhand and he was born there. He has submitted a ration card and also a certificate from the Gram Panchayat of a village in District Uttarkashi of Uttrakhand.
Name of the person, shown in the certificate and the ration card, is different from the name of the Petitioner, inasmuch as in the two documents, Petitioner''s name is shown as Dalveer Singh, whereas according to police record, which has been produced, name of the Petitioner is Dalveer alias Dal Bahadur son of Bhim Bahadur, in the documents, name of the father of the person is shown to be Ram Lal alias Bhim Bahadur.
In view of the abovestated position, petition is dismissed, with a direction to the trial Court to dispose of the case by 30th June, 2011.
