Heard.
Petitioner has sought indulgence of this Court to direct the respondents not to construct the bridge over petitioner’s land without acquiring his agricultural field situated at Village & Post Bhagchuri, Tehsil Khatima, Distt. U.S. Nagar being Khasra No.763/1M, 561/1/1/ and 762/1; a further writ of mandamus is sought directing the respondents to re-open 06 drainage system as existed before 2019 at the Westside of the bridge situated at Parveen River.
From a perusal of writ petition and the relief claimed therein, it appears that the petitioner wants to seek injunction from this Court, which power is not available with this Court; and for that purpose, petitioner has the remedy to file civil suit under the private law remedy available to him.
Accordingly, the writ petition is dismissed as not maintainable. However, the petitioner would be at liberty to avail appropriate remedy as per law.
Pending application, if any, stands disposed of.
