The jurisdiction of this Court has been invoked under Article 226/227 of the Constitution of India praying for issuance of a writ in the nature of mandamus directing the respondents to pay the interest on the withheld service benefits i.e. leave encashment. @ 12% per annum on delayed period i.e. from 31.01.2020 till 13.03.2025 i.e. till the date same were released, as the said benefit were withheld by the respondent illegally and without any cogent reason along with further interest which has not been paid to the petitioner so far.
Learned counsel for the petitioner submits that he will be satisfied in case a direction be issued to the respondent/State to decide the representation dated 14.05.2025 (Annexure P-6).
Learned State counsel assures the Court that representation dated 14.05.2025 (Annexure P-6) will be decided by passing a speaking order, within a period of six weeks from today and a copy of said speaking order will be supplied to the petitioner within one week thereafter.
The petition in the aforesaid terms stands disposed off.
