ORAL JUDGMENT

This appeal has been filed seeking to challenge a judgment dated 15.10.2025 passed by the learned Senior Civil Judge and JMFC, Sira, in R.A.No.27/2024 [hereinafter referred to as the “Impugned Judgment”]. By the Impugned Judgment, the appeal filed against a decree dated 01.06.2024, passed in O.S.No.177/2021 on the file of the Principal Civil Judge and JMFC, Sira, has been dismissed.

Despite the matter being called out twice, there is no appearance on behalf of the appellant.

There was no appearance on behalf of the appellant on the last 2 dates of hearing either and the following orders were passed:

On 06.08.2026:

“On behalf of the appellant time prayed on the ground of ill health of arguing counsel. Re-list on 02.09.2026.”

On 02.09.2026:

“None appears for appellant. List this matter on 25.09.2026.”

It seems that the appellant is not interested in prosecuting the matter. Given the fact that the appellant is not appearing in the matter, the appeal is dismissed in default and for non-prosecution. All pending application(s) shall stand closed.
