In this petition, petitioners seek for the following reliefs:

”i. Issue an appropriate writ/ Order / direction in the nature of Certiorari, to quash the Tender Notification No. Sri. Ma. Ma. Kshetra. A. Pra/Guttige/8/PR/69/24-25 dated 11.06.2024 issued by the Respondent Authority over the Shops bearing No.24 & 21 situated at Moodala Male Vanijya Samskerana Maligegalu for being illegal, capricious, biased and arbitrary, produced herewith as ANNEXURE-M, and;

ii. Grant such other relief/order/Directions as this Hon'ble Court deems fir in the facts and circumstances of the case, in the interest of justice and equity.”

After arguing the matter for sometime, learned Counsel for the petitioners submits that due to bonafide reasons, unavoidable circumstances and sufficient cause, the petitioners were not able to submit their bid before the respondent at 4:00.pm., on 01.07.2024 and as a special case, permission may be granted to submit the bid before 2:00.pm., on 02.07.2024.

Learned Counsel for the respondent fairly submits that by treating the present matter as a special case and without making it a precedent, the petitioners may be permitted to submit their bid at 2.00:pm., on 02.07.2024, which shall be considered by the respondent in accordance with law.

In view of the aforesaid facts and circumstances, I deem it just and appropriate to dispose of this petition permitting the petitioners to submit their bid to the respondent in relation to the E-tender auction at Annexure-M, before 2:00.pm., on 02.07.2024.

It is made clear that in the event the petitioners submit their bid to the respondent within 2:00.pm., on 02.07.2024, the respondent shall consider the same and proceed further in accordance with law.

It is made clear that the present order is being passed in the special/peculiar facts and circumstances of the instant case and the same shall not be treated as a precedent nor shall have any precedential value for any purpose whatsoever.
