At the outset Mr. Santosh Kumar Rout, learned Counsel appearing for the Respondent No. 2-Bank of Maharashtra, submits that the original bank guarantee was not invoked within the stipulated period and has since expired. He further submits that, the bank guarantee having expired without being invoked within the stipulated period, the same cannot now be encashed.

In view of the aforesaid submission, learned Senior Counsel appearing for the Petitioner seeks leave to withdraw the present petition.

In view of the aforesaid, the petition is dismissed as withdrawn.
