Both these Writ Petitions have been filed by the respective petitioners seeking for a direction to declare their results. In W.P.(C)No. 19000/11, the petitioner has completed B.Pharm course during 2006-2010. The petitioner has approached by this Court seeking for a direction to allow her to participate in the 4th year B.Pharm Examinations and this Court passed an interim order on 18.7.2011 and accordingly the petitioner has appeared for the examination.
In fact the objection by the University going by the counter affidavit in paragraph No. 5, produced in W.P.(C) No. 19000/11, is that as per the existing Regulation, for B.Pharm course, a candidate is permitted to appear for the 4th year B.Pharm examination only after passing the 2nd year papers completely and the petitioner has not cleared all the papers of the 2nd year B.Pharm degree examination.
As far as W.P.(C)No. 23641/12 is concerned, the petitioner was allowed to appear for the examination as per Exhibit P5 interim order in W.P.(C)No. 2685/10. The learned counsel for the petitioners relied upon the judgment of this Court in W.P.(C)No. 9616/11 by a learned Single Judge of this Court. It is stated that the same is rendered in a like matter. This Court directed the University to declare the results of the petitioner therein for the practical examination for the 3rd year B.Pharm Course.
The learned Standing Counsel for the University submitted that the results of the petitioners also will be declared in the light of the said judgment. The same is recorded. The entire process will be completed within a period of three weeks from today.
