Judgment
Heard Mr. D. Borah, learned counsel for the petitioner and Ms. A. Gayan, learned CGC for all the respondent Nos. 1 to 6.
The petitioner is a Constable in CISF and is serving at OPS Noonmati since 01.04.2018. Since the date of his appointment in the CISF from
08.03.2010 to 31.03.2018, the petitioner served in different CISF Units outside his home state.
By regular Inter Unit Transfer dated 27.04.2021, the petitioner has been transferred and posted at DHEP, Doyang in the State of Nagaland. By
Office Order dated 03.06.2021, the authority concerned directed to release the petitioner by 10.06.2021 enabling him to join his new place of posting at
Doyang. The petitioner submitted that his wife has recently conceived and that he is suffering from back pain. In these regard he submitted the
medical report of his wife and that of his dated 07.06.2021 and 08.06.2021 respectively.
The petitioner on 09.06.2021 submitted a representation before the respondent No.4, Deputy Inspector General, CISF, North East Zone Headquarters,
Guwahati to reconsider his transfer and posting at Doyang enabling him to continue his service in the CISF Unit in Noonmati itself submitting that if
the said transfer order dated 27.04.2021 is given effect, his pregnant wife and his 3 years old minor son will suffer irreparable loss.
Ms. Gayan, learned counsel for the respondents have placed the written instruction before the Court stating that the petitioner after issuance of the
order of regular transfer and posting did not file any representation immediately and only when the order dated 03.06.2021 regarding relieving of the
petitioner by 10.06.2021 have been issued, he filed the representation on 09.06.2021.
Ms. Gayan further submitted that the Administrative authority of the CISF Unit OPS Noonmati on 10.06.2021 has already forwarded the said
representation of the petitioner dated 09.06.2021 to the Group Commandant, CISF Group Headquarters, Guwahati for its necessary consideration and
the same is presently pending for disposal.
After hearing the learned counsels for the parties and considering the entire matter, this writ petition is disposed of at the motion state itself, without
entering into the merit of the case, directing the respondents to dispose of the representation of the petitioner dated 09.06.2021 by a reasoned order.
Till such disposal of the representation of the petitioner dated 09.06.2021, he may be allowed to continue his service in the present place of posting at
CISF Unit OPS at Noonmati.
The respondents shall intimate the petitioner about the outcome of his said representation dated 09.06.2021.
