C.S.Dias, J

1.

The revision petition is filed assailing the order in M.C.No.534/2011of the Family Court, Thrissur, rejecting the claim of the first revision petitioner for maintenance under Section 125 of the Code of Criminal Procedure,1973 (in short, ‘Code’).

2.

The revision petitioners had filed the above petition against the respondent before the Family Court, seeking monthly maintenance allowance at the rate of Rs.10,000 and Rs.5000/-, respectively.

3.

The Family Court, after analysing the materials placed on record, rejected the claim of the first revision petitioner and allowed the claim of the second revision petitioner, by directing the respondent to pay the second revision petitioner the maintenance amount of Rs.2,750/- per month.

4.

Heard; Sri. P.Santharam, the learned counsel appearing for the revision petitioners and Sri. Premchand M., the learned counsel appearing for the respondent.

4.

Sri. P. Santharam, on instructions, submitted that, it is learnt that the respondent has died during the pendency of the revision petition. There is no near relatives to be brought on record. Therefore, the revision petitioners are no longer desirous of prosecuting the revision petition. Hence, the revision petition may be dismissed as withdrawn. The said submission is recorded.

5.

In the light of the above submission, I am of the view that nothing further survives in the revision petition.

Resultantly, the revision petition is dismissed as withdrawn.
