Shri Prakash Chand, son of Shril Rikhi Ram, R/o Village Sukriyal, Tehsil Bangana, District Una, Himachal Pradesh invites attention of this Court to the inaction on the part of the respondent-State in not removing encroachment over the government land carried out by Shri Balak Ram, son of Shri Khushi Ram, a government employee.

From the response-affidavit filed by the State, the contents of the alleged petition have turned out to be correct. Now the proceedings for ejectment stand initiated against the encroacher.

As such, we dispose of the present letter petition with a direction to the Assistant Collector 1st Grade, Bangana, District Una, before whom such proceedings are pending, to decide the matter on merits expeditiously, in accordance with. Needless to add, all concerned shall be associated by affording adequate opportunity of hearing/representation.

Before parting, we wish to place on record appreciation qua the efforts put in by Mr. Sunny Modgil, learned Amicus Curiae, who, on the instructions of this Court, contacted letter petitioner and obtained necessary feedback.

Registry is directed to send a copy of this judgment to the Assistant Collector 1st Grade, Bangana, District Una for necessary action as well as to the letter petitioner to enable him to take follow up action with the concerned authorities.
