At the outset, learned Counsel appearing for the Decree Holder seeks leave to withdraw the petition with liberty to file it again as and when situation arise on the ground that the matter has already been settled between the parties in terms of settlement dated 05.09.2026.

Leave and liberty as aforesaid is granted.

The present petition is dismissed as withdrawn.
4.
Needless to say, that both the parties shall abide by the terms of the settlement.
5.
Interim reliefs (if any) stand vacated in terms of the settlement arrived between the parties.
6.
The parties are at liberty to seek restoration of the petition in the event of non-compliance with the Settlement Agreement dated 05.09.2026.
