Application filed by Resolution Professional seeking further 60 days extension of Corporate Insolvency Resolution Process beyond 330 days which is inclusive of pandemic lockdown period. Learned Counsel states that the exclusion of pandemic lockdown period in the year 2021 was also granted and accordingly 330 days were to expire on 14.02.2022. Learned Counsel states that CoC had already received three resolution plans in the month of December, 2021 and in 11th CoC meeting held on 20.12.2021, the same were being considered by CoC. CoC in its meeting held on 16.02.2022, passed resolution at Item No.5 deliberating the issue of seeking further extension of CIRP to enable them to consider the resolution plans. Deliberation by CoC of the plans are at advanced stage and in view of the possibility of resolution of the corporate debtor application is required to be allowed.
Considering the submission made, copies of minutes of CoC meetings on record, deliberations have been already advanced by the CoC members with respect to three resolution plans, we allow this application thereby grant further 60 days from expiry of 330 days i.e. 15.02.2022 and direct the RP to complete the process within the time period. Application is allowed and disposed of.
