Judgment
- THE grievance of the Complainant-Consumer Unity & Protection Centre, Nadiad, Gujarat - is that the Respondent Company which has taken substantial amounts by way of deposits from a very large number of people belonging mainly to the middle income group and even the poorer sections of society have defaulted in the matter of repayment of the amounts after they have become due and that, therefore, action should be taken against the Company compelling them to repay these overdue deposits. After having heard the representative of the Petitioner and Mr. Suri, learned Advocate appearing for the Respondents, we consider that the proper course to be adopted by the Petitioner in the circumstances of the case is to file a Petition for the winding up of the Respondent Company before the appropriate Court having jurisdiction under the Companies Act. On this limited ground, we dispose of this Petition as closed, reserving liberty to the Petitioner to take early steps for moving a Petition for winding up of the Company before the Court having jurisdiction. Petition disposed.
