Judgment
Ld. Counsel appearing on behalf of the CoC present.
IA(I.B.C)/1808(KB)2024:
a. This IA has been filed by Applicant under Section 22(3)(b) of the Insolvency and Bankruptcy Code, 2016 (“IB Code”) seeking for following reliefs, inter alia: -
i. Seeking approval of this Tribunal for replacement of the Interim Resolution Professional and appointment of Mr. Sanjai Kumar Gupta (Reg. No. IBBI/IPA-001/IP-P00592/2017-2018/11045) as the Resolution Professional under Section 23(3)(b) of the Code; ii. Alternatively, this Tribunal may forward the name of Mr. Sanjai Kumar Gupta (Reg. No. IBBI/IPA-001/IP-P00592/2017-2018/11045) to the IBBI for its confirmation; iii. Such further and/or other Order or Orders as this Court may deem fit and proper;
b. The reason is mentioned in page nos. 9 and 10 at paragraph nos. 6 to 9 of this application.
c. This IA is accompanied by an affidavit of Applicant at page nos. 13 and 14 of the said application.
d. We have perused the application and the documents attached therewith and heard the Id. Counsel for the CoC. We are satisfied with the prayer made in the IA should be allowed.
e. Accordingly, this IA(I.B.C)/1808(KB)2024 is allowed and disposed of to the extent mentioned above.
