Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with Giridih (M) P.S. Case No. 337 of 2016, corresponding to G.R. No. 2374 of 2016, registered for the offence punishable under Sections 461/379 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. Initially an First Information Report has been lodged against unknown persons and his name has only been surfaced on suspicion. Petitioner was arrested in another case but subsequently he has been alleged in the present case. Learned counsel further submits that the petitioner has obtained bail in another case. On the basis of confessional statement of the petitioner, some theft articles were recovered from the house of the petitioner. No Test Identification Parade has been done either of the petitioner or of the theft articles. Moreover, the petitioner is in judicial custody since 17.01.2017 and, therefore, he may be given the privilege of regular bail.

Learned A.P.P. opposes the prayer for bail and has submitted that he has already been wanted in two cases for which the petitioner is in accusations and, therefore, he does not deserve bail.

Having heard learned counsel for the petitioner and having gone through the case records and on the basis of custody, present petitioner, named above, is directed to be released on bail on executing bail bond of Rs. 20,000/- (Rs. Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M, Giridih in connection with Giridih (M) P.S. Case No. 337 of 2016, corresponding to G.R. No. 2374 of 2016 with condition that he will attend each and every date during trial unless it is dispensed of by the learned court below.
