R.K. Agrawal, J.—The petitioner had applied for enhancement of seats for B.Ed. course from 60 to 180. When the application was filed certain documents were not filed. All the documents except the No Objection Certificate was submitted within the extended period. The No Objection Certificate issued by the State Government has since been submitted in the month of May which is admitted to the learned counsel appearing for National Council for Teachers Education respondent Nos. 2 and 3.

In this view of the matter since all the documents have been submitted the respondents No. 2 and 3 were not justified in rejecting the application dated 582002 on the alleged ground that the documents were not filed within the time. It is well known that the State Government takes its own time in issuing No Objection Certificate for which the petitioner cannot be blamed since all the requirements have been fulfilled, the National Council for Teachers Education is directed to reconsider the matter and pass afresh order in accordance with law expeditiously preferably within one month from the date a certified copy of this order is filed before it. In the result the writ petition succeeds and is allowed. The impugned order dated 582002 is set aside.
