Judgment
Mr. A.K. Dixit and Mr. Anant Tewari appeared for the respondents.
The petitioner terminated the services of Respondent No. 5 Principal as a disciplinary action. This has been disapproved by the ViceChan on two grounds that the termination is effected without prior a management of the recognized.
learned counsel Before us is that the ViceChancellor has not heard the petitioner before passing the impugned order. Even o the wise relevant record regarding enquiry etc. was lot taken into account. Learned counsel for the petitioner at this siage made statement that the petitioner shall withdraw the order of termination of Respondent No. 5 and shall approach the ViceChancellor'' for seeking prior approval along with record. We grant permission to the petitioner to approach the ViceChancellor afresh. In case the proposal is submitted to the ViceChancellor in relation to the termination of Respondent No 5, the ViceChancellor shall grant necessary opportunity to the petitioner of being heard along with relevant record. The ViceChancellor shall also (sic) to the question regarding the recognition of the management.
With these observations the petition is disposed of.
Copy of this order be given to the learned counsel for the petitioner with in two days on payment of usual charges.
