Judgment
ORDER
On repeated call none appeared on behalf of the appellant whereas Ms JVL Bharati, learned counsel for R1 and R2 is present. Learned counsel for R3 is also present. Learned counsel for the Respondents points out that the present appeal was filed belatedly and IA No.899/2023 was filed alongwith the appeal for condoning the delay in filing the appeal. They have drawn our attention to para 1 to 3 of the IA to show that the reasons for delay which have been explained, appears to be noticed for its rejection. She further submits that the appeal has been filed even after period of 45 days i.e. after extended period of 15 days from the date of expiry of 30 days.
Be that as it may considering the fact that there is none appearance on behalf of the appellant, the appeal stands dismissed due to non-prosecution.
