Judgment
The writ petition has been listed under heading ‘For Orders’. Mr. Dash, learned advocate appears on behalf of applicant (workman) and submits, his client’s application made under section 17-B in Industrial Disputes Act, 1947 requires order being made.
Ms. Pattanayak, learned advocate, Additional Government Advocate appears on behalf of the Management and submits, the writ petition has impugned award dated 17th January, 2022. There be extension of time for her client to file objection to the application.
We notice that prayer in the writ petition is for restoration of the reference because the Management wants opportunity to cross-examine. This ground was taken by the Management in the restoration application, also dismissed by the Labour Court.
Extension of time granted is peremptory. The objection be filed by 29th March, 2023. Applicant may file reply thereto, to be accepted on adjourned date upon advance copy served.
It is made clear that the Management must plead facts relevant to adjudication of the section 17-B application. We would also require the management to contend on applicant’s relief under section 17-B, as may be lost on restoration of the reference.
