Vikram Nath, J.—Pursuant to the order dated 4.8.2010, Mr. Raju Sharma, Principal Secretary, Government of U.P. and also Ram Shiromani Yadav, Controller of Examinations, V.B.S. Purvanchal University, Jaunpur are present. Sri Suresh Singh, learned Addl. Chief Standing Counsel has filed an affidavit of the Principal Secretary. The specific stand taken in the affidavit is that Government is not creating any kind of hindrance in holding the examination of the candidates who were admitted in B.Ed. 2007-08 either through counseling or whose admissions have been ratified under the judgment dated 05.01.2009. With this stand of the State Government the University has no option left but to hold the examination and the defence taken on the previous date that the State Government is creating hurdle, no longer subsists.

Sri Anil Tiwari, learned Counsel appearing for the officers of the University, upon instructions from the Examination Controller has stated that the University needs one month''s time to complete the formalities and hold the examination. Time prayed for is allowed.

List on 13.9.2010. On the said date if the examination of remaining candidates of B.Ed. 2007-08 are not conducted and an affidavit to that effect is not filed, the Examination Controller shall again remain present.

Personal appearance of the Principal Secretary would not be necessary unless ordered otherwise.
