Judgment
It has been submitted by Sri R.L. Sharma, learned Counsel for the appellant, that the Committee of Management, the present appellant, has filed Civil Misc. Writ Petition No. 18594 of 2010 seeking amendment in the recognition granted by NCTE to be made effective from the session 2007-08 in which the learned Single Judge had called for the counter affidavit. He further submitted that the present appellant has also filed Civil Misc. Writ Petition No. 22668 of 2010, restraining Deen Dayal Upadhyaya Gorakhpur University, Gorakhpur in taking any action pursuant to the decision dated 20th January, 2010, in which this Court while calling for affidavits had directed that the decision, if any, taken shall be subject to the final decision of this Court. If those writ petitions are finally allowed, then the judgment given in the present writ petition would no longer stand.
The matter requires consideration.
As an interim measure it is provided that the amount of compensation of Rs. one lac awarded per student out of which Rs. Fifty thousand to be paid by the present appellant shall remain stayed. However, it is clarified that the remaining directions given in the impugned judgment has not been stayed.
