Judgment
Ld. Counsel for the petitioner present.
COMP.APPL/141(KB)2021-
This is an application filed by the original petitioners in C.P.(CAA)/1920(KB)2019 seeking two reliefs:
a. Correction in the appointed date in paragraph 13A of the order.
b. Enlargement of time to file a certified copy with the jurisdictional ROC, West Bengal, Kolkata.
Ld. Counsel appearing for the applicants submits that due to typographical error in the main company petition the appointed date has gone down
wrongly as 01.04.2016 instead of 01.04.2018. As per the scheme has been annexed as annexure A at page 30 of the main company petition that C.P.
(CAA)/1920(KB)2019 the appointed date as defined at page 4 of the main CP defines the appointed date as 1st April 2018.
Look into the totality of these circumstances, we believe that it is a bona fide typographical error that has crept into C.P.(CAA)/1920(KB)2019
while mentioning the appointed date.
In these circumstances, we hereby order that the appointed date mentioned in para 13A of the order dated 31.08.2021 shall be read as 1st of April,
2018 instead of 1st of April 2016 as mentioned therein. We also note that in para 3 of the said order dated 31.08.2021 the correct appointed date that
is 1st April 2018 has been mentioned.
We also hereby enlarge the time of filing the certified copy of the order dated 31.08.2021 along with the certified copy of today’s order with
ROC, West Bengal up to 28.02.2022.
COMP.APPL/141(KB)2021 shall stand disposed of with the above directions.
