Heard on application filed under Section 439 of Cr.P.C. filed on 27.01.2021 on behalf of Chunnilal Buddekar, who was arrested on 14.01.2021 in
connection with the Crime No. 32/2021 registered at Police Station, Lalbarra, District Balaghat for the offences punishable under Sections 379 of IPC,
Section 4-A of Miner Mineral Act and Sec. 3/181 of M.V. Act.
It is submitted by the applicant's counsel that challan has been filed. The applicant having no any criminal background. Therefore, he should be
enlarged on bail.
On the other side, the State opposed the application. But it is frankly admitted that as per case diary, this is the first offence against the applicant. The
case is related to the theft of sand. One trolley filled with sand has been seized on 14.01.2021.
Looking to the absence of previous criminal background and other circumstances of the case, the application is allowed. Applicant Chunnilal Buddekar
be released on bail upon his furnishing a personal bail bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) and a personal bond of the same
amount to the satisfaction of the trial Court.
At the time of releasing from custody, all the instructions issued by the government related to Covid-19 shall also be followed by the concerned
authority.
Accordingly, this M.Cr.C. stands allowed.
