By way of present Contempt Petition filed under Section 17 of the H.P. Administrative Tribunal Act, whereby Tribunal below having taken note of the submission made on behalf of the petitioner that his case is squarely covered under judgment rendered by Hon'ble Supreme Court in Mool Raj Upadhyaya Vs, State of H.P, and others, 1994, Supp(2) Supreme Court Cases 316, disposed of the petition with the direction to respondent/competent authority to consider the case of the applicant and grant similar benefit, if he is found similarly situate within a period of three months.
Having carefully perused the compliance affidavit filed by respondent No.1, this Court finds that pursuant to aforesaid judgment passed by Tribunal below, case of the petitioner came to be considered and rejected vide order dated 17.1.2018, passed by Executive Director (Pers.). HPSEB Ltd. Vidyut Bhawan, Shimla-4, Annexure (R-1).
Having perused the aforesaid order passed by respondent, this Court is convinced and satisfied that the directions contained in the judgment alleged to have been violated, have been duly complied with and as such nothing survives in the present case, accordingly the same is closed. Notices issued to the respondents are hereby discharged, however, liberty reserved to the petitioner to file appropriate proceedings in the competent Court of law, if still he is aggrieved.
