Judgment
Kurian Joseph, C.J.—Writ petition is filed with the following prayers:
i) That the orders dated 2.11.2010 vide Annexure P-3, transferring the Petitioner from Dharamshala (wrongly stated Dehra) to Haridwar, on promotion, may kindly be quashed and set-aside forthwith.
ii) That the Respondent No. 1 may be directed to redress the hardships by deciding the representations dated 16.3.2011, 23.3.2011 and 27.4.2011 vide Annexures P-4 to P-6 by adjusting the Petitioner at same station at Dharamshala or to adjust him at one of the adjoining stations i.e. Palampur or Hamirpur; against available vacant posts in the same manner in which benefit of adjustment was given to similar other incumbents as in Annexure P-3 forthwith.
iii) That the action of the Respondents in transferring the Petitioner, on promotion, from Dharamshala to Haridwar (about 400 Kms) but in retaining/adjusting similar other incumbents at same or adjoining stations may kindly be held as illegal, discriminatory and unsustainable.
Petitioner filed various representations and the last among them is Annexure P-7. There will be a direction to the first Respondent to look into Annexure P-7, advert to the submissions made therein and pass appropriate orders thereon in accordance with law and justice, within a period of one month from the date of production of a copy of this judgment alongwith a copy of the writ petition by the Petitioner before the first Respondent.
With the above direction, the writ petition stands disposed of, so also the pending application(s), if any.
