Judgment
Heard the learned counsel for the parties.
Mr. Bhobe, learned counsel for the petitioners submits that the petitioners, for the present will be satisfied if they are granted an opportunity of hearing before the next installment is recovered by the respondents towards alleged satisfaction of some audit objections. Mr. Bhobe agreed that no further notice of hearing is required.
Mr. Shirodkar states that next installment is due to be deducted on or before 20th April 2022. He submits that there is no dispute about the amount and therefore, there is no reason to interfere with the deductions that are being made.
Since the next installment is due to be deducted only on 20th April 2022, we think that there will be no harm if the petitioners' version is considered. This is no doubt, without prejudice to Mr. Shirodkar's contention that the representations made by the petitioners have already been considered.
Accordingly, we direct that the authorized representative of the petitioners will be granted a hearing by the Director of Higher Education on 6th April 2022 at 11.00 a.m. and upon consideration of representations made by the petitioners and the version which they put forth on the said date, the Director shall make appropriate orders and communicate the same to the petitioners. Since this exercise is to be completed before 18th April 2022, there is no question of ordering any restraint at this stage.
We make it clear that we have not gone into the rival contentions in this matter and therefore, all contentions of all parties are left open.
This petition is disposed of. There shall be no order for costs.
