Judgment
V.D. Gyani, J.—Heard learned Counsel for the Petitioner.
The Petitioner claiming to be the widow of deceased Lankeswar Rajbongshi @ Roy, prays for a direction to the Respondents to release the family pension in her favour. She has filed four documents in support of her claim, which as can be gathered from them was initiated way back in 1980, as can be seen from Annexure-IV. Thereafter, her claim was forwarded to the District Superintendent of Police for enquiry and report, which the Petitioner has not placed on record, although a subsequent certificate issued by the Sub Divisional Officer, certifying the Petitioner as the surviving members of the family of Late Lankeswar Roy, has been placed on record vide Annexure-6. Apparently it is a civil claim based on legal character of being the widow of deceased Lankeswar and the proper forum would be civil court. In view of the apparent delay of almost 15 years, her claim could well have been settled long before if she has placed on record a succession certificate and if she produces one, the Respondents are directed to release her family pension.
With this observation, the petition is disposed of with no order as to costs.
