This is the bail application U/S.483 of the BNSS by the petitioner for grant of bail in connection with Padampur PS Case No.192 of 2023 arising out of Spl. GR No.57-A of 2023 pending in the Court of learned Addl. Sessions Judge, Padampur for commission of offences punishable U/Ss. 20(b)(ii)(C)/29/25 of the NDPS Act, on the allegation of possessing 476 Kgs and 280 Grams of Contraband Ganja.
Heard, Mr. Sk. Zafarulla, learned counsel for the petitioner and Mr. M.R. Patra, learned Addl. PP in the matter and perused the record.
Mr. Zafarulla places before this Court the order passed by the Apex Court in Special Leave to Appeal (Crl.) No(s). 8322 of 2026 granting bail to co-accused Santosh Meher and it is found that the Apex Court while granting bail to co-accused has inter alia observed the following at paragraph-5:-
“5.Keeping the overall facts and circumstances, the period undergoes; the nature of allegation; other accused A4-Surat Mehar @ Subrat Mehar and A6- Sesha @ Seshadev Mehar being on bail and also bearing in mind the twin condition of Section 37 of NDPS, we are of the opinion that the petitioner has made out a case for bail.”
In the meantime, co-accused Bhagirathi Meher @ Bhagrathi Meher in BLAPL No. 3908 of 2026 have already been granted bail by co-ordinate Benches of this Court. In the aforesaid premises and on consideration of materials placed on record, this Court without expressing any view on merit, admits the petitioner to bail.
Hence, the bail application of the Petitioner stands allowed and the Petitioner is allowed to go on bail on furnishing bail bonds of Rs.1,00,000/- (Rupees One Lakh) only with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it.
Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
