The petitioner has moved this Court with the following prayers:-

10.1. Issue an appropriate writ of certiorari or any other writ or order, quashing the ""Notification no.F 13-4/food/2006/29 dated 27/9/2006 (Annexure-

P/1) amending the Chhattisgarh Kerosene Licensing Order 1979 and Demand Notice No.2505/Khadya/anu.pe.Diesel/2018 dated 17/12/2018 issued

under letter no./8713/Khadya- sancha/2018 dated 13.11.2018 (Annexure P/2).

10.2. Issue any other writ, order or direction as this Hon'ble Court may deem just and fair under the circumstances of the case;

10.3 For such further and other reliefs as the nature and circumstances of the case may require.

When the matter came-up for consideration before this Court yesterday, it was submitted on the part of the learned counsel for the petitioner that

after filing of this writ petition, some subsequent development has taken place and the respondent Government has already issued some amendments

with regard to the disputed Notification. Hence, the clarification was sought for in this regard.

Today, when the matter is taken-up, learned counsel representing the State submits that the information gathered by the petitioner was correct and

that, a new Notification bearing No.F 4-1/2015/29-1/Food/Part dated 5.7.2019 has been issued whereby the Notification under challenge, is

superceded and the matter has become infrutuous.

We have perused the copy of Notification dated 5.7.2019 placed for consideration.

In the above circumstance, we hold that no further deliberation thus required to be made by this Court as nothing survives for adjudication. The writ

petition is accordingly disposed off.
