By the present writ petition, the petitioners seek quashment of the impugned promotion order dated 26.12.2025 (Annexure P/1), so far as it relates to the petitioners, and further seek a direction towards the respondent authorities to correct the gradation list dated 06.11.2024 and consider the case of the petitioners for promotion to the post of Lecturer (Biology).

Learned counsel appearing for the petitioners submits that the petitioners are presently working on the post of Teacher (LB) at their respective places of posting and were initially appointed as Shikshakarmi Grade-II in the year 2008 and thereafter absorbed as Teacher (LB) w.e.f. 01.07.2018. She submits that in the gradation list dated 01.04.2023, the petitioners were placed above private respondent Nos.4 to 22 in accordance with their seniority from the date of initial appointment, whereas in the subsequent final combined gradation list dated 06.11.2024, the said respondents, who are stated to be junior to the petitioners, have been placed above them. She further submits that based upon the said gradation list, the promotion order dated 26.12.2025 was issued, whereby private respondent Nos.4 to 22 were promoted to the post of Lecturer (Biology), while the petitioners were not considered for promotion despite being eligible. She would further contend that some of the petitioners had already submitted representations before the Director of Public Instructions seeking correction of the gradation list, but the same have not been considered and decided till date. She, therefore, prays that the petitioners may be permitted to submit a fresh representation before the competent authority with a direction to consider and decide the same in accordance with law and, if any anomaly is found, to extend consequential benefits to the petitioners.

Learned State counsel submits that the petitioners are alleging an anomaly in the gradation list and are seeking correction of their respective seniority. He submits that if the petitioners submit fresh representations, their grievance will be considered by the competent authority in accordance with law after affording an opportunity of hearing to the petitioners as well as the affected private respondents. He would submit that after considering the claim of the petitioners and the objections, if any, raised by the affected parties, a detailed and reasoned order shall be passed by the competent authority.

Learned counsel appearing for the private respondents has no objection to the aforesaid submission.

I have heard learned counsel for the parties and perused the documents appended with the petition.

The principal grievance of the petitioners is with regard to the alleged anomaly in the gradation list dated 06.11.2024, whereby, according to them, private respondent Nos.4 to 22, who are stated to be junior to the petitioners, have been placed above them, resulting in their non-consideration for promotion vide order dated 26.12.2025.

In view of the above and considering the limited prayer made by learned counsel for the petitioners and the submission made by learned State counsel, the present writ petition is disposed of with liberty to the petitioners to submit a fresh representation before the competent respondent authority/ Director of Public Instructions (DPI) within a period of 20 days from today, raising their grievance regarding the gradation list dated 06.11.2024. In the event of filing of such representations, the DPI shall issue notice to all affected parties, including the private respondents, consider their replies/objections, if any, and thereafter examine the alleged anomaly in the gradation list and pass a detailed and reasoned order in accordance with law within a period of 90 days from the date of submission of the representation. If any anomaly is found in the gradation list, the competent authority shall also pass consequential orders, in accordance with law.

With the aforesaid direction and liberty, the present writ petition stands disposed of.
