Virendra Saran, J.—Heard Sri Sudhir Kumar Srivastava learned counsel for the applicants and Sri S. P. Malviya learned counsel appearing for the prosecution.

The applicants have been granted bail by the learned Special C J M Allahabad under Section 167, Cr. P. C. for default on the pan of prosecution to file complaint against the applicants and the prosecution did not offer and explanation for the lapse on its part. However, the applicants are still in jail as they could not furnish two surety bonds of Rs. 1,00,000 each. J. I. C.47

Considering the entire facts and circumstances of the case the bail order dated 1931996 of the Special C. J. M. is modified to this extent that the amount of personal as well as surety bonds of each of the applicants is reduced from Rs. 1,00,000 each to Rs. 25,000 each. However, the learned Magistrate shall verify the genuineness and the status of the sureties.

With the above direction the application is finally disposed of.
