Judgment
V. Narasingh, J
Heard learned counsel for the Petitioner, learned counsel for the State and learned counsel for the Informant.
The Petitioner is an accused in Special Case No.56 of 2022 pending before the Court of learned Additional District and Sessions Judge-cum-Special Judge, Keonjhar, arising out of Keonjhar Town P.S. Case No.185 of 2022, for commission of alleged offences under Sections 363/370/370-A(1)(2)(5)/ 372/376(3)/323/506/34 IPC and Section 6 of the POCSO Act.
Being aggrieved by the rejection of her application for bail U/s.439 Cr.P.C. by the learned Adhoc Addl. District & Sessions Judge (FTSC), Keonjhar I/c by order dated 19.04.2023 in the aforementioned case, the present BLAPL has been filed.
It is submitted by the learned counsel that the Petitioner is who is a lady is in custody since 25.05.2022.
Though admittedly trial has commenced the counsels at the Bar are not able to apprise this Court as to whether the victims have been examined in the meanwhile or not.
Considering the same, Registry is requested to call for a report from the learned Court in seisin regarding the stage of trial and the time frame within which the same can be concluded and as to whether the victims have been examined or not. The statement of the witnesses examined till the date of the submission of such report be also transmitted to this Court.
List this matter on 19.01.2023 along with such report.
